São Paulo is a Brazilian city with the highest production of garbage per person. In 2009, the collection of recyclables accounted for around 40 million tons and started to be more than 80 million tons as of 2015. In 2018, there was a significant setback: 76,907 tons of recyclable waste was collected; this represents 13 % less compared to 2017 and the worst mark since 2014 [3] [9].

In April 2018, the then vice-mayor, Bruno Covas (PSDB), took office after João Dória (PSDB), who was only 15 months in office, ran for office and was elected governor of the state. Thereafter, the city issued a public notice with bureaucratic requirements that caused the disabling of 27 of the 49 recycling cooperatives and left about 750 families without income [2] [7] [8].

The city government understands that collaboration with cooperatives is governed by a 2011 decree, which includes requirements such as tax compliance, as well as health and safety conditions at work [6]. Thus, the notice began to require cooperatives to deliver tax certificates, work plans, minutes and various documents with notary registration, in addition to the civil society organization registration, which also requires a series of documents [2] [8 ]. However, according to Roberto Laureano da Rocha, from the national coordination of the National Movement of Recyclable Material Collectors (MNCR), the city requires a certificate, but the Environmental Sanitation Law does not define this certificate as a criterion for the qualification of the cooperative [1] .

According to Carlos Anderson, from São José Alpino Cooperative, the city is asking for some things that are not viable, such as, for example, the use of a warehouse: “the rent of a warehouse is expensive, a recycling cooperative cannot afford to pay for it”. And, in addition, the city government suspends the material, which is the only source of income for the cooperatives and makes expensive demands to enable them. For Anderson, the city wants, in fact, to disable cooperatives to favor large companies interested in public contracts [4].

In February 2019, the city expanded selective collection and added R$ 2.9 million per month to the contracts of the concessionaires Loga and Ecourbis, which total R $ 1 billion per year [6].

On May 7th, 2019, world recycling day, waste pickers organized a protest in front of the city hall. On May 30, a public hearing was organized with the Public Defender's Office of São Paulo, with the participation of waste pickers, representatives of the City Hall, the Public Ministry, the Public Defender's Office of the Union and councilors.

In a letter delivered to the mayor, the Waste Pickers Committee of the City of São Paulo states that waste pickers provide a free service to the city hall, as about 50% of what arrives to work is rejected. They also say that the amount collected from the sale of materials is not enough to pay the bills of the cooperatives and allow enough distribution of the results to the members. They protest for the growing increase in taxes and fiscal obligations and for the increase in bureaucratic requirements that prevent the participation of many Waste Pickers' organizations [2].

Em abril de 2018, o então vice-prefeito, Bruno Covas (PSDB), assumiu a prefeitura após João Dória (PSDB), que ficou apenas 15 meses no cargo, candidatar-se e eleger-se governador do estado. A partir daí, a prefeitura lançou edital com exigências burocráticas que provocaram a desabilitação de 27 das 49 cooperativas e deixaram cerca de 750 famílias sem renda [2] [7] [8].

A prefeitura entende que a colaboração com as cooperativas é regida por decreto de 2011, que inclui exigências como regularidade fiscal, condições de saúde e segurança do trabalho [6]. Assim, o edital passou a exigir das cooperativas a entrega de certidões de tributos, plano de trabalho, atas e diversos documentos com registro em cartório, além do cadastro de organização da sociedade civil, que requer também uma série de documentos [2] [8]. No entanto, conforme Roberto Laureano da Rocha, da coordenação nacional do Movimento Nacional de Catadores de Materiais Recicláveis (MNCR), a prefeitura exige um certificado, mas a Lei de Saneamento Ambiental não define este certificado como critério para a habilitação da cooperativa [1].

Conforme Carlos Anderson, da Cooperativa São José Alpino, a prefeitura está pedindo algumas coisas que são inviáveis, como, por exemplo, o uso de galpão: “o aluguel de um galpão é caro, uma cooperativa de reciclagem não tem condições de pagar”. E, além disso, a prefeitura suspende o material, que é a única fonte de renda das cooperativas, e faz exigências que custam caro, para habilitá-las. Para Anderson, a prefeitura quer, de fato, desabilitar as cooperativas para favorecer as grandes empresas interessadas nos contratos públicos [4].

Em fevereiro de 2019, a prefeitura ampliou a coleta seletiva e acrescentou de R$ 2,9 milhões mensais aos contratos das concessionárias Loga e Ecourbis, que totalizam R$ 1 bilhão por ano [6].

Em 07 maio de 2019, dia mundial da reciclagem, os catadores organizaram protesto em frente a prefeitura. No dia 30 de maio, organizaram com a Defensoria Pública de São Paulo uma audiência pública com a participação de catadores, representantes da Prefeitura, do Ministério Público, da Defensoria Pública da União e de vereadores.

Em carta entregue ao prefeito, o Comitê de Catadores da Cidade de São Paulo afirma que os catadores prestam um serviço gratuito à prefeitura, pois cerca de 50 % do que lhes chega para trabalhar é rejeito. Dizem também que o valor arrecadado com a venda dos materiais não é suficiente para pagar as contas das cooperativas e permitir uma distribuição suficiente dos resultados aos cooperados. Protestam pelo crescente aumento de tributos e obrigações fiscais e pelo aumento de exigências burocráticas que inviabilizam a participação de muitas organizações de Catadores [2].
